GENERAL TERMS AND CONDITIONS OF SALE OF BEST ITALIAN SELECTION S.R.L.

1. Premises

These general terms and conditions of sale (hereinafter, “General Conditions”) govern the purchase of products and services offered by Best Italian Selection S.r.l. (hereinafter, “BIS”), through the website www.bestitalianselection.it (hereinafter, “Site”), in compliance with Italian and European legislation, in particular Legislative Decree 206/2005 (Consumer Code) and EU Regulation 2016/679 (GDPR).

2. Definitions

• Customer: natural or legal person who purchases the Products on the Site.
• Contract: sales agreement between BIS and the Customer.
• Products: goods offered for sale on the Site.
• Site: the website www.bestitalianselection.it.
• BIS: Best Italian Selection S.r.l., owner of the Site.

3. Object of the Contract

3.1. The General Conditions govern the sale of the Products through the Site.

3.2. The Customer is required to carefully read the General Conditions before placing an order.

3.3. BIS reserves the right to modify the General Conditions at any time, by giving notice on the Site.

4. Purchase Procedure

4.1. The Customer can select the Products and add them to the shopping cart.

4.2. Before confirming the order, the Customer must provide shipping and payment details, and accept the General Conditions and the Privacy Policy.

4.3. The order constitutes a contractual proposal from the Customer.

4.4. The Contract is concluded upon acceptance of the order by BIS, communicated via email confirmation.

4.5. The Customer is responsible for the accuracy of the data provided.

5. Prices and Payments

5.1. The prices of the Products are indicated on the Site and are inclusive of VAT.

5.2. Payment can be made through the methods indicated on the Site.

5.3. In case of a request for an invoice, the Customer must provide the necessary data during the order procedure.

6. Shipping and Delivery

6.1. BIS ships to Italy and abroad, through selected couriers.

6.2. Shipping times and costs are indicated on the Site.

6.3. BIS is not responsible for any delays in delivery due to force majeure or third parties.

6.4. The Customer is required to check the integrity of the Products upon delivery.

7. Right of Withdrawal and Returns

7.1. The consumer Customer has the right to withdraw from the Contract within 14 days from the delivery of the Products, without providing any reasons.

7.2. To exercise the right of withdrawal, the Customer may notify BIS of their decision by means of an explicit declaration sent via certified email (PEC), registered letter or email to customerservice@bestitalianselection.it, or through the dedicated digital withdrawal function available on the Site pursuant to Article 7.6 below.

7.3. Following the withdrawal notice, the Products must be returned intact, unused, complete with all their parts and in their original packaging, within 14 days from the date on which the Customer communicated the decision to withdraw. The return shipping costs are borne by the Customer, unless otherwise agreed in writing.

7.4. BIS will refund the price of the Products and the standard shipping costs within 14 days from receipt of the withdrawal notice. BIS may withhold the refund until the returned Products have been received, or until the Customer provides evidence of having shipped them, whichever is earlier.

7.5. The right of withdrawal is excluded for personalized, perishable, or sealed Products that cannot be returned for hygienic reasons once opened after delivery, pursuant to Article 59 of the Consumer Code.

7.6. Digital withdrawal function (Article 54-bis of the Consumer Code). For contracts concluded through the Site, the consumer Customer may also exercise the right of withdrawal through the dedicated digital function “Withdraw from the contract here“, available in the footer of every page of the Site and on the dedicated withdrawal page. The procedure allows the Customer to enter the essential information (order number, email used for the purchase and Products for which they are withdrawing), to confirm the request through the dedicated “Confirm withdrawal” command, and to receive, on a durable medium, an acknowledgement containing the text of the withdrawal declaration as well as the date and time of transmission. The function is available for the entire 14-day withdrawal period.

7.7. The provisions of the “Right of Withdrawal” page of the Site remain in force, containing the complete information on the right of withdrawal, the return and refund procedures, the exclusions set out in Article 59 of the Consumer Code, and the model withdrawal form.

8. Legal Guarantee of Conformity

8.1. BIS is liable for any lack of conformity of the Products, in accordance with the Consumer Code.

8.2. The Customer has the right to repair or replacement of defective Products, or to a price reduction or termination of the Contract.

8.3. The Customer must report the defect within 2 months of discovery.

9. Limitation of Liability

9.1. BIS is not liable for indirect or consequential damages.

9.2. In case of purchase of alcoholic beverages, the Customer declares to be of legal drinking age.

10. Privacy

10.1. BIS processes the Customer’s personal data in compliance with the GDPR and Italian legislation.

10.2. The privacy policy is available on the Site.

10.3. The processing of personal data related to withdrawal requests, including those submitted through the digital function referred to in Article 7.6, is described in the privacy policy of the Site.

11. Applicable Law and Jurisdiction

11.1. The Contract is governed by Italian law.

11.2. For disputes with consumers, the court of the Customer’s place of residence or domicile shall have jurisdiction.

11.3. For disputes with professionals, the court of Rome shall have jurisdiction.

12. Online Dispute Resolution (ODR)

12.1. The European Commission provides an online platform for dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr.

Vexatious Clauses

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the Customer declares to have specifically read and accepted the following clauses: 6 (Shipping and Delivery), 7 (Right of Withdrawal and Returns), 8 (Legal Guarantee of Conformity), 9 (Limitation of Liability), 11 (Applicable Law and Jurisdiction).
