Information on the right of withdrawal

Pursuant to Articles 52 and following of the Italian Consumer Code (Legislative Decree No. 206/2005), any Customer acting as a Consumer has the right to withdraw from a distance purchase contract without providing any reason and without incurring any costs other than those provided by law, within fourteen (14) days from the date of receipt of the products.

The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, acquires physical possession of the goods.

How to exercise the right of withdrawal

To exercise the right of withdrawal, the Customer must communicate their decision by means of an explicit declaration sent to:

The communication must include at least:

• Customer’s full name;
• Order number;
• Order date;
• Products for which the withdrawal is requested;
• Customer’s telephone number and e-mail address.

To meet the withdrawal deadline, it is sufficient that the communication is sent before the expiry of the 14-day withdrawal period.

Exercising the withdrawal through the online digital function
Pursuant to Article 54-bis of the Italian Consumer Code (Legislative Decree No. 206/2005, as amended by Legislative Decree No. 209/2025 implementing EU Directive 2023/2673), in addition to the methods described above, Consumer Customers may exercise their right of withdrawal directly online through the dedicated digital function“Withdraw from the contract here“,designed to provide a simple, immediate and traceable procedure.

This function is available:

• on this “Right of Withdrawal” page, through the online withdrawal form provided below;
• in the footer of every page of the site;
• in the order confirmation email, through the dedicated link;
• on the “Order received” page, displayed immediately after purchase.

The guided procedure includes the following steps:

1. The Customer enters the order number and the e-mail address used for the purchase and receives a verification link via e-mail;
2. The Customer selects the order and the products for which the withdrawal is requested and completes the withdrawal declaration;
3. The Customer confirms the request by clicking the “Confirm Withdrawal” button.

Once the request has been successfully submitted, the Customer will receive without undue delay, on a durable medium (e-mail), an acknowledgement of receipt containing the text of the withdrawal declaration together with the date and time of submission.

The withdrawal function remains available throughout the entire 14-day withdrawal period.

The exclusions provided for under Article 59 of the Italian Consumer Code, as detailed below, shall also apply to withdrawals exercised through this digital function.

Return of the products
Following the withdrawal notice, the Customer must return the products within fourteen (14) days from the date on which the withdrawal was communicated.

The products must be returned to:

Returned products must be:

• intact and unused;
• complete with all their parts;
• returned in their original packaging;
• properly packed for transport;
• stored according to the instructions provided on the packaging.

The Customer shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Unless otherwise agreed in writing, return shipping costs shall be borne by the Customer.

Refund
If the withdrawal is validly exercised, Best Italian Selection S.r.l. will reimburse all payments received from the Customer, including any standard delivery charges paid for the original shipment.

The refund will be processed within fourteen (14) days from receipt of the withdrawal notice. However, Best Italian Selection S.r.l. may withhold reimbursement until the returned products have been received or until the Customer has supplied evidence of having sent back the goods, whichever occurs first. The refund will be made using the same payment method used by the Customer for the original transaction, unless otherwise agreed between the parties.

Exceptions to the Right of Withdrawal
Pursuant to Article 59 of Legislative Decree No. 206/2005, the right of withdrawal does not apply to:

• goods made to the Customer’s specifications or clearly personalized;
• goods liable to deteriorate or expire rapidly;
• sealed goods which are not suitable for return due to health protection or hygiene reasons and have been unsealed after delivery;
• goods which, after delivery, have been inseparably mixed with other items.

Specific Provisions for Food Products
Best Italian Selection S.r.l. markets food products intended for human consumption, including but not limited to:

• dry pasta;
• sauces and condiments;
• tomato preserves and processed tomato products;
• extra virgin olive oil;
• pâtés and gourmet specialties;
• biscuits and cookies;
• baked goods;
• panettone and seasonal confectionery products;
• wine;
• sparkling wines;
• liqueurs and grappa;
• other packaged food products.

For hygiene, food safety, traceability and consumer protection reasons, the right of withdrawal cannot be exercised where:

• the safety seal has been removed or tampered with;
• the original packaging has been opened;
• the product has been wholly or partially consumed;
• the product has been altered due to improper storage by the Customer;
• labels, closures or identification marks have been removed or damaged.

In particular, returns of opened bottles of wine, sparkling wine, liqueurs or grappa, as well as opened, tasted, used or partially consumed food products, will not be accepted-

Best Italian Selection S.r.l. reserves the right to verify the integrity of returned products before processing any refund.

Damaged or Non-Conforming Products
Customers may report damaged, defective or non-conforming products within 48 hours of delivery by sending a communication to: customerservice@bestitalianselection.it

including:

• order number;

• description of the issue;

• photographs of the product and the packaging received.

In such cases, the protections provided by applicable consumer protection legislation and legal conformity warranty provisions shall apply.
